TERMS AND CONDITIONS FOR DJ Cabs DRIVERS / CAPTAINS
(CAB, TAXI, AUTO-RICKSHAW, E-RICKSHAW & EV CAR SERVICES)

These Terms and Conditions (“T&Cs”) govern the relationship between Aarambh Global Mobility Ventures Private Limited (“Company”, “Aarambh”, “we”, “us” or “our”) and the drivers, vehicle owners or operators registered with or using the Driver Junction / DJ Cabs mobile application, website and related technology platform (“DJ Cabs Platform”).
The Company operates a technology-enabled mobility platform through which customers may request passenger transportation services from eligible independent drivers/captains operating permitted Cab, Taxi, Auto-Rickshaw, E-Rickshaw and EV Car vehicles.
For the purposes of these T&Cs, such persons shall be referred to as “Driver”, “Captain”, “you” or “your”.
The transportation services are provided by eligible independent Drivers/vehicle operators through the DJ Platform, subject to applicable law and the applicable business model communicated by the Company.
By registering on, accessing or using the DJ Platform, or by accepting a ride request, you confirm that you have read, understood and agreed to these T&Cs, the DJ Cabs Privacy Policy, applicable safety policies, payment policies, vehicle requirements and other applicable DJ policies.
If you do not agree with these T&Cs, you must not register for or use the DJ Platform.
1. DEFINITIONS
1.1 Company
“Company” means Aarambh Global Mobility Ventures Private Limited.
1.2 DJ Cabs Platform
“DJ Cabs Platform” means the Driver Junction / DJ mobile application, website, software, technology, systems and related digital services operated or made available by the Company.
1.3 Driver / Captain
“Driver” or “Captain” means an individual, vehicle owner or eligible vehicle operator who has successfully registered and been approved to provide passenger transportation services through the DJ Platform.
1.4 Customer
“Customer” means a person who uses the DJ Cabs Platform to request or avail a passenger transportation service.
1.5 Vehicle
“Vehicle” means only an eligible and approved Cab, Taxi, Auto-Rickshaw, E-Rickshaw or EV Car registered on the DJ Platform and legally permitted to provide passenger transportation services.
1.6 Ride / Service
“Ride” or “Service” means passenger transportation provided through the DJ Cabs Platform using an eligible Vehicle.
1.7 Ride Request
“Ride Request” means a request submitted by a Customer through the DJ Cabs Platform for a Ride.
1.8 Fare
“Fare” means the amount payable for a Ride as displayed, calculated or otherwise determined through the DJ Cabs Platform, applicable commercial terms and applicable law.
2. ROLE OF DJ AND NATURE OF SERVICES
2.1
DJ Cabs is a technology-enabled passenger mobility platform operated by Aarambh Global Mobility Ventures Private Limited.
2.2
The DJ Cabs Platform may facilitate:
Driver registration and onboarding;
Customer ride bookings;
Ride requests and acceptance;
Pickup and destination information;
Fare information;
Digital payment facilities;
Ride and transaction records;
Navigation and communication features;
Customer support;
Safety and security features; and
Other technology-enabled mobility features introduced by the Company.
2.3
Depending upon the applicable business and regulatory model, DJ may facilitate interaction between Customers and Drivers and provide technology, payment, communication, safety and support services.
2.4
The applicable commercial model, including applicable Driver fees, commissions, subscriptions or other charges, may be communicated through the DJ Cabs Platform, onboarding documents or applicable policies.
2.5
Unless expressly agreed otherwise in writing, registration on the DJ Platform does not by itself create an employment relationship between the Company and the Driver.
2.6
The Driver remains responsible for complying with all applicable laws, permits, licences, vehicle requirements and transportation regulations.
3. DRIVER ELIGIBILITY AND ONBOARDING
To register and provide services through DJ Cabs, the Driver must:
be at least 18 years of age or satisfy any higher age requirement applicable under law;
possess a valid driving licence appropriate for the Vehicle;
possess valid registration and other legally required Vehicle documents;
possess valid insurance as required by law;
possess applicable permits and authorisations;
satisfy applicable fitness and pollution requirements;
successfully complete DJ's onboarding and verification process;
provide accurate and complete information;
comply with applicable traffic and transportation laws; and
satisfy any additional legal or safety requirements applicable to the relevant Vehicle or service category.
The Company may reject, suspend or discontinue onboarding if required information or documents are incomplete, inaccurate, expired, fraudulent or cannot reasonably be verified.
4. DRIVER ACCOUNT
4.1
The Driver must create and maintain an account using accurate information.
4.2
The Driver is responsible for keeping account credentials, OTPs and authentication information secure.
4.3
The Driver must not:
share the Driver Account with another person;
permit another person to operate through the Driver Account;
sell, rent or transfer the Driver Account;
create fraudulent or duplicate accounts; or
use another Driver's account.
4.4
The Driver must immediately notify DJ if unauthorized access to the account is suspected.
4.5
The Company may suspend or restrict an account where it reasonably suspects fraud, unauthorized access, inaccurate information, safety concerns or violation of these T&Cs.
5. DRIVER INFORMATION AND VERIFICATION
The Company may collect and process information required for onboarding, verification, safety, payment, support, legal compliance and operation of the DJ Cabs Platform.
Such information may include:
Name;
Photograph;
Mobile number;
Email address;
Address information;
Identity information;
Driving licence;
Vehicle registration details;
Permit information;
Insurance information;
Pollution and fitness documents;
Bank/payment information;
Emergency contact information;
Ride and transaction information;
Location and trip information; and
Other information reasonably required for operating the DJ Cabs Platform.
The Company may use authorized service providers for identity verification, document verification, payment processing, technology, customer support, fraud prevention and other legitimate functions.
The processing of personal information shall be subject to applicable law and the Company's Privacy Policy.
6. ACCURACY AND VALIDITY OF INFORMATION
The Driver represents that all information and documents provided to the Company are true, accurate, complete and current.
The Driver must promptly update the Company if:
a driving licence expires, is suspended or cancelled;
a permit expires, is suspended or cancelled;
insurance expires or becomes invalid;
Vehicle registration changes;
Vehicle ownership changes;
any material information becomes inaccurate; or
any other document required for providing services becomes invalid.
Providing forged, manipulated or knowingly false documents may result in immediate suspension or termination and may be reported to the appropriate authorities where required by law.
7. VEHICLE REQUIREMENTS
Only an approved Vehicle may be used for providing passenger transportation services through DJ Cabs.
Eligible Vehicle categories under these T&Cs are:
Cab
Taxi
Auto-Rickshaw
E-Rickshaw
EV Car
The Vehicle must:
be legally registered;
have valid insurance;
have required permits;
satisfy applicable fitness requirements;
have a valid pollution certificate where applicable;
comply with applicable tax and regulatory requirements;
be maintained in safe and roadworthy condition; and
satisfy DJ's Cabs applicable vehicle eligibility requirements.
The Company may require Vehicle verification or inspection in accordance with applicable law and Company policy.
8. VEHICLE DOCUMENTS
The Driver must maintain all applicable and valid documents, including:
Registration Certificate;
Driving Licence;
Permit;
Insurance;
Fitness Certificate, where required;
Pollution Under Control Certificate, where applicable;
Applicable tax documents; and
Other documents required under applicable law.
The Driver must immediately inform DJ Cabs if any required document expires, is suspended, cancelled or otherwise becomes invalid.
9. RIDE REQUESTS
Customers may request Rides through the DJ Cabs Platform.
Eligible Drivers may receive Ride Requests through the Platform.
The Driver may accept or reject Ride Requests subject to applicable law, Company policies and the Driver's operating requirements.
The Company does not guarantee any minimum number of Ride Requests, rides, earnings or income unless expressly agreed in writing.
10. ACCEPTANCE AND PERFORMANCE OF RIDES
After accepting a Ride Request, the Driver should:
proceed towards the pickup location within a reasonable time;
communicate with the Customer only for legitimate Ride-related purposes;
provide transportation in a safe and professional manner;
follow lawful and reasonably requested routes, subject to traffic and safety conditions;
follow applicable traffic laws;
transport the Customer only within the legally permitted Vehicle capacity;
accurately update Ride status through the DJ Cabs Platform; and
complete the Ride at the applicable destination.
The Driver must not deliberately accept a Ride with no intention of completing it.
11. CANCELLATION
The Driver may cancel a Ride in accordance with applicable DJ cancellation policies and applicable law.
The Driver must not:
deliberately manipulate cancellations;
falsely mark a Customer as unavailable;
induce a Customer to cancel for an improper benefit;
create fraudulent Ride cancellations; or
misuse the cancellation system.
Repeated or fraudulent cancellation activity may result in corrective action, suspension or termination, subject to applicable law.
12. FARE AND PAYMENT
12.1 Fare
The Fare for a Ride may be displayed or calculated through the DJ Platform based on the applicable fare structure and applicable law.
The Fare may take into account factors such as:
distance;
time;
Vehicle category;
applicable tolls;
applicable taxes;
applicable parking charges;
location;
demand; and
other lawful pricing factors.
12.2 Cash Payment
Where cash payment is enabled, the Customer may pay the applicable amount directly to the Driver.
The Driver must not demand unauthorized additional charges.
12.3 Digital Payment
Where digital payment is enabled, Customers may pay using payment methods supported by DJ or its authorized payment partners.
The Company or authorized payment partner may collect and settle eligible amounts according to the applicable settlement process.
12.4 Company Charges
Where applicable and permitted by law, the Company may charge the Driver:
platform fees;
commission;
subscription fees;
technology/service fees;
payment-related charges; and
applicable taxes.
The applicable commercial terms shall be communicated to the Driver through the DJ Platform or other appropriate communication.
12.5 Taxes
Each party shall be responsible for taxes applicable to it under law.
The Driver is responsible for complying with applicable tax obligations arising from the Driver's activities.
Where the Company is legally required to deduct, collect or report any tax or amount, it may do so in accordance with applicable law.
13. NO UNAUTHORISED CHARGES
The Driver must not demand or collect from a Customer any amount that is:
not applicable;
not authorized;
not displayed or communicated through the applicable fare mechanism; or
otherwise prohibited by law or DJ policy.
14. DRIVER CONDUCT
The Driver must:
behave respectfully and professionally;
treat Customers fairly and courteously;
comply with traffic laws;
drive safely and responsibly;
maintain the Vehicle in clean and roadworthy condition;
maintain reasonable personal hygiene;
follow lawful safety instructions;
cooperate with legitimate customer support and safety investigations;
maintain all required documents;
report serious accidents or safety incidents promptly; and
comply with applicable DJ policies.
The Driver must not harass, threaten, abuse, intimidate or discriminate against Customers, other Drivers or Company personnel.
15. ZERO TOLERANCE FOR INTOXICATION
The Driver must not provide a Ride while under the influence of:
alcohol;
narcotics;
illegal drugs;
intoxicating substances; or
any substance that materially impairs safe driving.
The Driver must not consume alcohol or prohibited intoxicating substances while providing a Ride.
Suspected intoxication or dangerous driving may result in immediate suspension pending investigation and may result in termination.
16. SAFETY REQUIREMENTS
Safety of Customers, Drivers and other road users is a fundamental requirement of DJ.
The Driver must:
obey traffic rules;
follow applicable speed limits;
drive responsibly;
use seat belts where legally required;
ensure the Vehicle is roadworthy;
not drive while intoxicated or dangerously fatigued;
not carry more passengers than legally permitted;
not overload the Vehicle;
use a mobile phone only in a manner permitted by law while driving;
comply with emergency and safety procedures; and
promptly report serious accidents and safety incidents.
DJ Cabs may use technology-based safety features such as trip monitoring, GPS/location services, driver verification, emergency assistance and other lawful safety measures.
17. CUSTOMER COMMUNICATION AND PRIVACY
The Driver may communicate with Customers only for legitimate purposes connected with the Ride.
The Driver must not use Customer contact information for:
harassment;
unwanted personal contact;
unauthorized marketing;
personal solicitation;
intimidation;
unrelated commercial activities; or
any unlawful purpose.
The Driver must not sell, copy, disclose, store or misuse Customer personal information.
Customer information obtained through DJ Cabs must be used only as necessary for providing the relevant Ride and as permitted by applicable law.
18. PROHIBITED ACTIVITIES
The Driver must not:
use another person's Driver Account;
allow another person to use the Driver Account;
submit false or fraudulent documents;
manipulate GPS or location information;
manipulate Ride status;
create fake bookings;
manipulate fares or payments;
misuse incentives or promotional programmes;
misuse Customer information;
intentionally induce Customers to cancel for improper benefit;
interfere with DJ Cabs Platform systems;
attempt to gain unauthorized access to DJ Cabs systems;
use bots or automated tools to manipulate the Platform;
upload malware, viruses or harmful code;
reverse engineer or unlawfully copy the DJ Cabs Platform;
harass, threaten or abuse Customers or Company personnel;
engage in dangerous or reckless driving;
drive while intoxicated;
use the Vehicle for unlawful purposes; or
violate any applicable law or DJ Cabs safety policy.
19. CONFIDENTIALITY
The Driver may receive confidential information relating to Customers, Drivers, pricing, operations, technology, security, business activities and the DJ Cabs Platform.
Such information must be used only for legitimate DJ Cabs-related purposes.
The Driver must not disclose, sell, copy or commercially exploit confidential information except:
where necessary to provide the Ride;
with lawful authorization from the Company; or
where disclosure is required by law.
Confidentiality obligations concerning Customer information continue after the Driver stops using the DJ Cabs Platform, to the extent required by law or the nature of the information.
20. DATA PROTECTION AND PRIVACY
The Company may process Driver information for legitimate purposes including:
onboarding;
identity verification;
Vehicle verification;
Ride allocation;
payment and settlement;
safety;
fraud prevention;
customer support;
legal compliance;
dispute resolution;
analytics;
Platform operation; and
service improvement.
The processing of personal information shall be governed by applicable privacy and data-protection laws and the Company's Privacy Policy.
The Driver must take reasonable steps to protect Customer information from unauthorized access or disclosure.
Where legally required or permitted, the Company may provide relevant information to law-enforcement authorities, courts, regulators, insurers, payment partners or other authorized entities.
21. INTELLECTUAL PROPERTY
The DJ Cabs Platform and its related intellectual property, including:
software;
mobile application;
website;
logos;
trademarks;
graphics;
interface;
content;
technology;
databases; and
other proprietary materials
are owned by or licensed to the Company or its licensors.
The Driver receives only a limited, non-exclusive, non-transferable and revocable right to use the authorized Driver features of the DJ Cabs Platform.
The Driver must not:
copy the Platform;
modify the Platform;
reverse engineer the Platform;
attempt to obtain source code;
create derivative products using DJ Cabs proprietary materials;
copy DJ Cabs branding or trademarks;
commercially exploit DJ Cabs intellectual property; or
use automated systems to access the Platform without authorization.
22. INDEPENDENT DRIVER RELATIONSHIP
Subject to applicable law and the applicable business structure:
DJ Cabs operates a technology-enabled mobility platform;
the Driver provides passenger transportation services using an eligible Vehicle;
registration on DJ Cabs does not automatically create an employer-employee relationship;
these T&Cs do not create a partnership, joint venture or franchise relationship; and
the Driver has no authority to legally bind the Company unless expressly authorized in writing.
Nothing in this section overrides any mandatory rights, protections or obligations imposed by applicable law.
23. INSURANCE AND ACCIDENTS
The Driver must maintain all insurance required by applicable law for the Vehicle and passenger transportation services.
The Driver must promptly report any material incident, including:
road accident;
injury;
death;
Vehicle damage;
theft;
assault;
serious Customer safety incident;
police involvement; or
other serious incident.
The Driver must cooperate with reasonable investigations by the Company, insurers, law-enforcement authorities and regulators.
Where DJ Cabs provides or facilitates any additional insurance or accident protection programme, the applicable terms, eligibility requirements, limits and exclusions shall apply.
24. FRAUD AND PLATFORM MANIPULATION
The following may constitute serious violations:
fake Rides;
fake bookings;
GPS manipulation;
account sharing;
duplicate fraudulent accounts;
payment manipulation;
fraudulent cancellations;
incentive manipulation;
falsification of documents;
misuse of Customer information; and
attempts to bypass Platform security.
The Company may suspend or terminate accounts and take other lawful action where fraud or serious misuse is suspected or established.
25. PLATFORM AVAILABILITY
The Company will make reasonable efforts to maintain the DJ Platform but does not guarantee uninterrupted availability.
The Platform may temporarily become unavailable because of:
maintenance;
technical problems;
network failure;
internet disruption;
payment system failure;
cyber incidents;
power failure;
government restrictions;
regulatory requirements; or
other circumstances beyond the Company's reasonable control.
The Company may modify, suspend or discontinue Platform features or services where reasonably necessary and subject to applicable law.
26. DISCLAIMERS
To the maximum extent permitted by applicable law:
the DJ Cabs Platform is provided on an “AS IS” and “AS AVAILABLE” basis;
the Company does not guarantee uninterrupted or error-free operation;
the Company does not guarantee any minimum number of Rides, Customers or earnings;
the Company does not guarantee that every Ride Request will be accepted or completed;
the Company is not responsible for delays caused by traffic, weather, road conditions, network failures, government restrictions or other events beyond its reasonable control;
the Driver remains responsible for safe operation of the Vehicle and compliance with applicable law; and
nothing in these T&Cs excludes liability that cannot legally be excluded.
27. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Company shall not be liable for indirect, incidental, special, punitive or consequential losses arising from the Driver's use of the DJ Cabs Platform.
The Company shall not be responsible for losses arising from:
unlawful or negligent acts of the Driver;
failure to maintain required Vehicle documents;
Vehicle defects attributable to the Driver or Vehicle owner;
traffic violations by the Driver;
unauthorized use of the Driver Account;
misuse of Customer information by the Driver; or
circumstances beyond the Company's reasonable control.
Nothing in these T&Cs shall limit any liability that cannot legally be limited or excluded.
28. INDEMNITY
To the maximum extent permitted by applicable law, the Driver agrees to indemnify and hold harmless the Company, its directors, officers, employees, affiliates, contractors and service providers against claims, losses, damages, penalties, liabilities and reasonable costs arising from:
breach of these T&Cs;
violation of applicable law;
fraudulent or unlawful conduct;
negligent or wilful misconduct;
false information or documents;
operation or use of the Vehicle;
passenger transportation services provided by the Driver;
misuse of Customer information; or
personal injury, death or property damage attributable to the Driver's conduct.
This clause shall not require the Driver to indemnify the Company for liability that cannot legally be imposed on the Driver.
29. SUSPENSION AND TERMINATION
The Company may suspend, restrict or terminate the Driver Account, subject to applicable law, where:
these T&Cs are breached;
required documents expire or become invalid;
fraudulent activity is suspected or established;
serious safety concerns arise;
the Driver provides false information;
the Driver engages in dangerous or unlawful conduct;
the Driver misuses Customer information;
the Vehicle becomes ineligible;
the Driver's licence or permit is suspended or cancelled;
serious or repeated complaints are received; or
continued access creates a material safety, legal, regulatory or security risk.
Where reasonably practicable, the Company may provide an opportunity to respond or complete an investigation.
However, immediate suspension may be applied where reasonably necessary for safety, fraud prevention, legal compliance or protection of Customers, Drivers or the DJ Platform.
Upon Termination
The Driver must:
stop using the DJ Cabs Platform;
stop representing themselves as an active DJ Driver/Captain;
stop using DJ Cabs intellectual property;
protect and delete/return confidential information where required; and
settle legitimate outstanding financial obligations.
Provisions that are intended to survive termination shall continue to apply.
30. COMPLAINTS AND INVESTIGATION
The Company may investigate complaints relating to:
Drivers;
Customers;
Rides;
Vehicles;
payments;
safety;
fraud; or
Platform misuse.
The Driver agrees to reasonably cooperate with legitimate investigations.
The Company may review relevant Ride records, communications, payment information, location/trip information and other Platform records to the extent permitted by applicable law.
Where required or permitted by law, relevant information may be provided to law-enforcement, regulatory, judicial or governmental authorities.
31. GOVERNING LAW
These T&Cs shall be governed by the laws of India, subject to applicable state-specific transportation laws and regulations.
The parties should first attempt to resolve disputes through the Company's internal complaint and resolution process.
Nothing in these T&Cs prevents either party from approaching a competent statutory or judicial authority where such right cannot legally be excluded.
32. DISPUTE RESOLUTION
The parties shall first attempt to resolve disputes amicably.
Where legally permissible, a dispute that cannot be resolved amicably may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.
Any arbitration arrangement shall be subject to applicable law.
Nothing in this section prevents either party from seeking urgent legal or statutory relief where legally available.
33. ASSIGNMENT
The Driver may not sell, transfer or assign the Driver Account or rights under these T&Cs without the Company's prior approval.
The Company may transfer or assign its rights and obligations in connection with the DJ Platform to an affiliate, successor or other lawful entity, subject to applicable law.
34. AMENDMENTS
The Company may update these T&Cs from time to time because of:
changes in law;
regulatory requirements;
changes to the DJ Cabs Platform;
changes in safety requirements;
operational requirements; or
other legitimate business requirements.
Material changes may be communicated through the DJ Platform, email, SMS, WhatsApp, push notification or another appropriate communication method.
The updated T&Cs shall become effective from the date specified in the updated version.
Continued use of the DJ Cabs Platform after the effective date may constitute acceptance, subject to applicable law.
35. SEVERABILITY
If any provision of these T&Cs is held to be invalid, unlawful or unenforceable, it shall be modified or limited to the minimum extent necessary where legally permissible.
The remaining provisions shall continue to remain effective.
36. FORCE MAJEURE
The Company shall not be responsible for delay or failure caused by circumstances beyond its reasonable control, including:
natural disasters;
severe weather;
floods;
earthquakes;
war;
riots;
civil disturbances;
government restrictions;
regulatory orders;
internet or telecommunications failure;
power failure;
cyber incidents; or
other similar events beyond reasonable control.
37. NOTICES AND COMMUNICATION
The Company may communicate with Drivers through:
DJ Cabs App;
SMS;
WhatsApp;
email;
telephone;
push notification; or
other legally permissible communication methods.
The Driver must keep registered contact information accurate and updated.

For emergencies involving immediate danger, accident, injury or other urgent circumstances, the Driver should first contact the appropriate emergency services/competent authorities and then notify DJ as soon as reasonably practicable.
The Company may update support and grievance details from time to time through the DJ Cabs Platform or website.
39. ELECTRONIC ACCEPTANCE
By clicking “I Agree”, “Accept”, “Register”, “Continue” or any similar button, or by registering for or continuing to use the DJ Cabs Platform, the Driver acknowledges that:
the Driver has read and understood these T&Cs;
the Driver agrees to be bound by these T&Cs;
the information provided by the Driver is accurate;
the Driver has the legal capacity to accept these T&Cs; and
the Driver agrees to comply with applicable laws, safety requirements and DJ policies.
Electronic acceptance may have legal effect to the extent recognised under applicable law.

DRIVER / CAPTAIN ACKNOWLEDGEMENT
