TERMS & CONDITIONS FOR USERS

DRIVER JUNCTION – DJ Cabs

Bike Taxi and Instant Courier Parcel Delivery Services

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “Sender”, “Receiver”, “you” or “your”) and Aarambh Global Mobility Ventures Private Limited, operating under the brand name Driver Junction – DJ Cabs (“DJ Cabs”, “Company”, “we”, “us” or “our”).

These Terms govern your access to and use of the Driver Junction – DJ Cabs mobile application, website, technology platform and related services (collectively, the “Platform”).

These Terms apply only to:

These Terms do not apply to car, cab, auto-rickshaw or other four-wheeler passenger transportation services unless separately notified by DJ.

By downloading, accessing, registering with, or using the DJ Platform, or by booking or availing any Service, you acknowledge that you have read, understood and agreed to these Terms, together with the DJ Privacy Policy, Safety Policy, Cancellation & Refund Policy, Account Deletion Policy and other applicable policies displayed on the Platform.

If you do not agree with these Terms, please do not use the Platform or Services.

 

1. DEFINITIONS

1.1 “Platform”

Means the Driver Junction – DJ mobile application, website, software, technology infrastructure and related digital services operated or controlled by DJ.

1.2 “Services”

Means the services made available through the Platform, including:

For clarity, the Services covered by these Terms do not include car, cab, auto-rickshaw or other four-wheeler passenger transportation services.

1.3 “User” or “Customer”

Means any person who registers with, accesses or uses the Platform or books or avails a Service.

1.4 “Passenger”

Means a User who books or travels through a Bike Taxi / Two-Wheeler Passenger Service.

1.5 “Sender”

Means a User who books a Courier or Parcel Delivery Service and hands over a parcel or item for delivery.

1.6 “Receiver”

Means the person designated by the Sender to receive a parcel or item.

1.7 “Driver” or “Captain”

Means a person providing Bike Taxi or Courier and Parcel Delivery Services through or in connection with the DJ Platform.

1.8 “Delivery Partner”

Means a Driver, rider, courier partner, vehicle owner, fleet operator or other authorised service provider engaged or associated with DJ for providing Courier or Parcel Delivery Services.

1.9 “Partner”

Means a Driver, Delivery Partner, vehicle owner, fleet operator, service provider or other business partner associated with DJ for providing or supporting the Services.

1.10 “Booking”

Means a request made by a User through the Platform for a Bike Taxi Service or Courier and Parcel Delivery Service.

1.11 “Ride”

Means a Bike Taxi / Two-Wheeler Passenger Service booked through the Platform.

1.12 “Delivery”

Means the collection, transportation and attempted delivery of a parcel or item through the Platform.

1.13 “Parcel” or “Item”

Means the goods, documents, packages or other permitted items handed over by the Sender for delivery.

1.14 “Fare” or “Delivery Charge”

Means the amount payable for a Service, as displayed, estimated or otherwise determined through the Platform, subject to Applicable Law.

1.15 “Account”

Means the account created by a User for accessing and using the Platform.

1.16 “Applicable Law”

Means applicable laws, rules, regulations, notifications, orders, governmental directions and regulatory requirements applicable in India and the relevant State or location where the Service is provided.

 

2. ABOUT DRIVER JUNCTION – DJ Cabs

  1. DJ Cabs is a technology-enabled platform operated by Aarambh Global Mobility Ventures Private Limited.
  2. The Platform enables Users to request and coordinate:
    • Bike Taxi / Two-Wheeler Passenger Services; and
    • Instant Courier and Parcel Delivery Services.
  3. Depending on the applicable operating model, Services may be provided by Drivers, Delivery Partners, vehicle owners, fleet operators or other authorised Partners.
  4. DJ Cabs provides technology and operational support such as:
    • booking requests;
    • Driver or Delivery Partner matching;
    • location services;
    • trip and delivery tracking;
    • communication;
    • payment facilitation;
    • customer support;
    • safety features;
    • delivery status updates; and
    • other technology-enabled services.
  5. DJ Cabs may act as a technology and coordination platform. The actual transportation or delivery may be performed by an authorised Driver, Delivery Partner or Partner.
  6. Availability of a particular Driver, Delivery Partner, vehicle or Service is not guaranteed at all times.
  7. DJ Cabs may introduce, modify, suspend or discontinue Services, features or service areas subject to Applicable Law.

 

3. ELIGIBILITY

  1. You must generally be 18 years or older to independently create an Account and use the Platform.
  2. You must provide accurate and complete information.
  3. You must have legal capacity to enter into an agreement under Applicable Law.
  4. You must use the Platform only for lawful purposes.
  5. You must not use another person's Account without proper authorization.
  6. DJ Cabs may suspend or terminate an Account if information provided by the User is false, misleading, fraudulent or unverifiable.
  7. A User booking a Bike Taxi Service must be legally permitted to travel as a passenger on a two-wheeler under Applicable Law.
  8. A Sender must have the legal right and authority to hand over the Parcel or Item for delivery.

 

4. ACCOUNT REGISTRATION

  1. Certain DJ Cabs Services require you to create an Account.
  2. You may be required to provide:
    • name;
    • mobile number;
    • email address;
    • pickup and destination details;
    • delivery address;
    • Receiver details;
    • profile information;
    • emergency contact information;
    • payment information; and
    • other information reasonably necessary to provide the Services.
  3. DJ Cabs may verify information directly or through authorized third-party service providers.
  4. You are responsible for maintaining the security of your Account and Device.
  5. You must immediately inform DJ if you believe that your Account has been accessed without authorization.
  6. You must not:
    • sell or transfer your Account;
    • create fraudulent Accounts;
    • create duplicate Accounts to misuse offers or restrictions;
    • impersonate another person; or
    • knowingly provide false information.
  7. The Sender is responsible for ensuring that the Receiver's contact and address details are accurate.

 

5. BIKE TAXI BOOKING AND RIDE REQUESTS

  1. A Passenger may enter a pickup location and destination and request a Bike Taxi Service through the Platform.
  2. DJ Cabs may identify available Drivers based on location, availability, vehicle category and operational requirements.
  3. A ride request does not guarantee that a Driver will accept the booking.
  4. A Driver may accept or decline a booking subject to Applicable Law and DJ policies.
  5. After acceptance, the Platform may display relevant information such as:
    • Driver name;
    • Driver photograph, where applicable;
    • vehicle details;
    • vehicle registration number;
    • estimated arrival time; and
    • other information reasonably necessary for the Ride.
  6. Estimated arrival times may change due to traffic, weather, road conditions, GPS limitations, network issues or other circumstances.
  7. Before boarding the two-wheeler, the Passenger should verify the Driver and vehicle details displayed in the DJ App.
  8. Passengers should not board a vehicle if the registration number or Driver details materially differ from those displayed in the Platform.
  9. A Driver may refuse or discontinue a Ride where reasonably necessary for safety or where permitted or required by law.

 

6. COURIER AND PARCEL DELIVERY BOOKING

  1. A Sender may enter the pickup address, delivery address and Receiver details and request a Delivery through the Platform.
  2. DJ Cabs may identify an available Delivery Partner based on location, availability, service area and operational requirements.
  3. A Delivery request does not guarantee that a Delivery Partner will accept the booking.
  4. After acceptance, the Platform may display relevant information such as:
    • Delivery Partner name;
    • photograph, where applicable;
    • vehicle details;
    • vehicle registration number, where applicable;
    • estimated pickup time;
    • estimated delivery time; and
    • delivery status.
  5. Estimated pickup and delivery times may change due to traffic, weather, road conditions, address issues, recipient availability, GPS limitations, network issues or other circumstances.
  6. The Sender must ensure that the Parcel is properly packed, sealed and ready for pickup.
  7. The Sender must provide accurate information about the Parcel, including its nature, quantity, size, weight and any special handling requirements.
  8. The Sender must not hand over a prohibited, dangerous, illegal or undeclared item.
  9. The Receiver or an authorised person may be required to provide an OTP, signature, confirmation or other proof of delivery.
  10. DJ Cabs may cancel, refuse, inspect or return a Parcel where there is a safety, legal, security, packaging, payment or service concern.

 

7. CUSTOMER RESPONSIBILITIES

Users agree to:

  1. provide correct pickup, destination and delivery information;
  2. provide accurate contact details for the Passenger, Sender and Receiver, as applicable;
  3. behave respectfully towards Drivers, Delivery Partners and other persons;
  4. follow reasonable safety instructions;
  5. comply with Applicable Law;
  6. wear a helmet when required for a Bike Taxi Service;
  7. use any safety equipment provided or required for the Service;
  8. comply with applicable passenger capacity requirements;
  9. keep personal belongings secure;
  10. ensure that Parcels are properly packed and labelled;
  11. remain available or ensure that an authorised person is available at the pickup or delivery location;
  12. report accidents, safety incidents, delivery issues or serious misconduct to DJ as soon as reasonably possible;
  13. not damage or misuse the vehicle or delivery equipment; and
  14. cooperate with reasonable safety, delivery and incident investigations.

 

8. PARCEL PACKAGING AND DECLARATION

  1. The Sender is solely responsible for proper packaging, sealing, labelling and declaration of the Parcel.
  2. The Parcel must be packed in a manner suitable for ordinary transportation by two-wheeler.
  3. The Sender must disclose any information reasonably necessary for safe handling and delivery.
  4. The Sender must not conceal the nature of the Parcel or provide false information.
  5. DJ Cabs or the Delivery Partner may refuse to accept a Parcel that:
    • is improperly packed;
    • is leaking, damaged or unsafe;
    • exceeds applicable size or weight limits;
    • cannot be safely carried on a two-wheeler;
    • contains a prohibited item;
    • requires special handling not offered by DJ; or
    • creates a risk to persons, vehicles or property.
  6. DJ Cabs may require the Sender to repack, remove or replace packaging before accepting the Parcel.
  7. The Sender remains responsible for damage caused by inadequate packaging or inaccurate declaration.

 

9. PROHIBITED PARCELS AND ITEMS

Users must not use the Platform to send, carry or deliver any item prohibited by Applicable Law or DJ policy, including, without limitation:

  1. illegal drugs, narcotics or psychotropic substances;
  2. weapons, firearms, ammunition or explosives;
  3. flammable, combustible, radioactive, toxic or hazardous substances;
  4. live animals, insects or plants where prohibited or requiring special permits;
  5. human remains, body parts or biological materials;
  6. stolen goods or goods obtained through unlawful means;
  7. counterfeit goods or goods infringing intellectual property rights;
  8. cash, currency, negotiable instruments or high-value financial instruments, unless expressly accepted by DJ in writing;
  9. jewellery, precious stones or high-value items, unless expressly accepted by DJ;
  10. medicines, medical devices or temperature-sensitive products requiring special handling, unless expressly accepted by DJ;
  11. perishable food or goods likely to spoil, leak or create a health risk;
  12. obscene, unlawful or offensive materials;
  13. government documents, identity documents or restricted documents where delivery is not legally authorized;
  14. goods requiring licences, permits or special transportation conditions that have not been disclosed and approved;
  15. any item that may damage the vehicle, Driver, Delivery Partner or other Parcels; or
  16. any other item prohibited by Applicable Law or DJ policy.

The Sender is responsible for ensuring that the Parcel is lawful and permitted for delivery.

 

10. DELIVERY, RECEIVER AVAILABILITY AND FAILED DELIVERY

  1. The Sender must ensure that the Receiver or an authorized person is available at the delivery address.
  2. The Receiver may be required to provide an OTP, signature, identification or other confirmation of delivery.
  3. A Delivery may be considered completed when:
    • the Parcel is handed over to the Receiver or authorized person;
    • the Receiver confirms receipt through the Platform;
    • the applicable delivery OTP is verified; or
    • delivery is otherwise recorded through the Platform.
  4. If delivery cannot be completed because:
    • the Receiver is unavailable;
    • the address is incorrect or incomplete;
    • the Receiver refuses to accept the Parcel;
    • the location is inaccessible;
    • the Parcel is prohibited or unsafe;
    • the Sender or Receiver cannot be contacted; or
    • another delivery issue occurs,

DJ Cabs or the Delivery Partner may attempt to contact the Sender or Receiver and may return the Parcel to the pickup location or another designated location.

  1. Additional charges may apply for waiting time, return delivery, reattempts or other permitted services.
  2. If the Sender or Receiver fails to collect a returned Parcel within the applicable period, DJ may handle the Parcel in accordance with Applicable Law and its applicable policy.
  3. DJ Cabs does not guarantee delivery within an exact time unless expressly stated for a particular Service.

 

11. CUSTOMER RESPONSIBILITIES FOR BIKE TAXI SERVICES

Passengers must:

  1. provide correct pickup and destination information;
  2. verify the Driver and vehicle before boarding;
  3. wear a helmet where required;
  4. sit safely and follow the Driver's reasonable safety instructions;
  5. comply with passenger capacity requirements;
  6. not interfere with vehicle controls;
  7. not ask the Driver to violate traffic laws;
  8. not carry prohibited or dangerous items;
  9. not behave in a manner that creates an unreasonable safety risk; and
  10. report safety concerns promptly to DJ.

 

12. PROHIBITED CONDUCT

Users must not:

  1. use the Platform for illegal activities;
  2. threaten, abuse, harass or assault a Driver, Delivery Partner, Receiver or other person;
  3. damage or intentionally misuse a vehicle;
  4. carry or send illegal, dangerous or prohibited materials;
  5. carry weapons or other prohibited items contrary to Applicable Law;
  6. use fake identity or fraudulent information;
  7. create fraudulent Accounts;
  8. manipulate fares, promotions, referrals or rewards;
  9. make fraudulent payment disputes or chargebacks;
  10. interfere with GPS or other Platform security features;
  11. introduce malware, viruses or harmful software;
  12. attempt unauthorised access to DJ systems;
  13. stalk or harass a Driver or Delivery Partner after completion of a Service;
  14. misuse Driver or Delivery Partner contact information;
  15. record or publish another person's private information without lawful authority;
  16. engage in discriminatory, sexually inappropriate, threatening or abusive conduct;
  17. use the Platform for unauthorised commercial solicitation;
  18. open, tamper with or interfere with another person's Parcel;
  19. falsely claim that a Parcel was not delivered;
  20. use the Platform to send a Parcel to an unsafe, inaccessible or unlawful location; or
  21. violate Applicable Law or these Terms.

DJ Cabs may restrict, suspend or terminate Accounts involved in prohibited conduct and may report unlawful activity to appropriate authorities where required or permitted by law.

 

13. DRIVER AND DELIVERY PARTNER INFORMATION

For the purpose of completing a Ride or Delivery, DJ Cabs may provide the User with relevant Driver or Delivery Partner information such as:

Users must use this information only for the relevant booking, safety, delivery and Service purposes.

Users must not:

 

14. LOCATION AND LIVE TRACKING

  1. DJ Cabs uses location technology to facilitate Bike Taxi and Courier and Parcel Delivery Services.
  2. Location information may be used for:
    • pickup and destination;
    • delivery address;
    • Driver or Delivery Partner matching;
    • navigation;
    • estimated arrival time;
    • live Ride tracking;
    • Parcel tracking;
    • safety;
    • emergency response;
    • customer support;
    • fraud prevention; and
    • service improvement.
  3. Users may be required to provide location permission for certain features.
  4. If location permission is disabled, certain DJ features may not function properly.
  5. Live tracking may be available during an active Ride or Delivery and may support authorised safety and customer support features.
  6. Location information may not always be accurate due to GPS limitations, network issues, device settings or other technical factors.

 

15. FARES, DELIVERY CHARGES AND PRICING

  1. The applicable fare or Delivery Charge may be displayed in the DJ Cabs App before or during a booking.
  2. Bike Taxi fares may depend on factors including:
    • distance;
    • time;
    • applicable taxes;
    • waiting time;
    • applicable regulatory requirements; and
    • other disclosed charges.
  3. Courier and Parcel Delivery Charges may depend on factors including:
    • pickup and delivery distance;
    • parcel size and weight;
    • service area;
    • waiting time;
    • return delivery;
    • reattempts;
    • applicable taxes;
    • applicable regulatory requirements; and
    • other disclosed charges.
  4. An estimated fare or Delivery Charge may differ from the final amount where circumstances during the Ride or Delivery affect the applicable charges.
  5. Additional charges will be applied only where permitted by Applicable Law and the applicable Service terms.
  6. Users are responsible for paying the applicable amount for the Service actually availed.
  7. The Sender is responsible for all charges relating to the Delivery, including permitted waiting, return, reattempt or additional handling charges.

 

16. PAYMENT

  1. DJ Cabs may support payment methods including:
    • UPI;
    • debit/credit cards;
    • net banking;
    • wallets;
    • cash, where available; and
    • other payment methods introduced by DJ Cabs.
  2. Payment processing may be handled by authorized payment gateways, banks or other payment service providers.
  3. Users must not use fraudulent, stolen or unauthorized payment instruments.
  4. Failed, reversed or unpaid transactions may result in restrictions on further use of the Platform, subject to Applicable Law.
  5. Refunds, where applicable, will be handled according to the DJ Cabs Cancellation & Refund Policy.
  6. Where cash payment is enabled, the User may be required to pay the applicable amount directly to the Driver or Delivery Partner.
  7. DJ Cabs may require payment of applicable charges before accepting or completing a Delivery.

 

17. CANCELLATION AND REFUNDS

  1. Users may cancel a booking subject to the applicable cancellation terms displayed in the DJ Cabs App.
  2. Cancellation charges may apply depending on the circumstances of cancellation.
  3. Cancellation charges may be applicable where:
    • a Driver or Delivery Partner has accepted the booking;
    • the Driver or Delivery Partner has travelled towards the pickup location;
    • the Passenger, Sender or Receiver is unavailable;
    • the Parcel has already been collected;
    • the User cancels after the Service has commenced;
    • repeated or abusive cancellation behaviour occurs; or
    • other circumstances specified by DJ Cabs apply.
  4. Refunds, where applicable, will be processed according to the DJ Cabs Cancellation & Refund Policy.
  5. DJ Cabs may waive or modify cancellation charges in appropriate circumstances, including technical problems, safety issues or exceptional situations.
  6. A refund may not be available for a Parcel that has already been collected, delivered, returned or damaged due to inadequate packaging or inaccurate information provided by the Sender, subject to Applicable Law and the applicable policy.

 

18. SAFETY AND SOS

  1. DJ Cabs provides safety features designed to support Users, Drivers and Delivery Partners.
  2. Depending on the Service and available functionality, safety features may include:
    • Driver or Delivery Partner verification;
    • vehicle verification;
    • live Ride or Delivery tracking;
    • trip or delivery sharing;
    • SOS/emergency assistance;
    • customer support; and
    • incident reporting.
  3. The SOS feature should be used only for genuine emergencies.
  4. In an immediate emergency, Users should also contact the appropriate emergency service directly, including 112 where applicable.
  5. Information relevant to an emergency may be shared with emergency contacts, emergency services, law enforcement authorities, insurers or other authorised parties where legally permitted and reasonably necessary.
  6. DJ Cabs cannot guarantee emergency response times because response may depend on network availability, location, emergency authorities and circumstances outside DJ's Cabs control.

 

19. ACCIDENTS, DAMAGE, LOSS AND INSURANCE

  1. DJ Cabs may provide insurance-related protection or access to insurance benefits for eligible Bike Taxi Passengers, Drivers, Delivery Partners or Parcels, subject to the applicable insurance arrangement.
  2. Where Customer or Parcel insurance is offered through the Platform, the User may choose whether to purchase such optional insurance unless Applicable Law or the relevant Service terms require otherwise.
  3. Insurance coverage, premium, eligibility, exclusions, limits and claim procedures shall be governed by the applicable insurance policy and insurer terms.
  4. DJ Cabs does not guarantee that every insurance claim will be approved or paid.
  5. Users should report accidents, loss, damage, theft, tampering or safety incidents to DJ as soon as reasonably possible.
  6. The Sender must retain proof of the Parcel's value, purchase, ownership and contents where relevant to a claim.
  7. DJ Cabs may assist in coordinating with the relevant Driver, Delivery Partner, Partner, insurer or emergency service where appropriate.
  8. The Sender remains responsible for loss or damage caused by:
    • prohibited or undeclared contents;
    • inadequate packaging;
    • inaccurate information;
    • improper labelling; or
    • failure to comply with these Terms.

 

20. BIKE TAXI / TWO-WHEELER SERVICES

  1. Bike Taxi Services are subject to vehicle availability and Applicable Law.
  2. The Passenger must comply with applicable helmet and passenger safety requirements.
  3. The number of passengers permitted on a two-wheeler shall be determined by Applicable Law and vehicle configuration.
  4. Passengers must not:
    • interfere with vehicle controls;
    • intentionally damage the motorcycle;
    • instruct the Driver to violate traffic laws;
    • carry prohibited materials; or
    • behave in a manner that creates an unreasonable safety risk.
  5. DJ Cabs may suspend Bike Taxi Services in locations where such Services are not legally permitted or operationally available.
  6. DJ Cabs does not provide car, cab or auto-rickshaw passenger services under these Terms.

 

21. INSTANT COURIER AND PARCEL DELIVERY SERVICES

  1. Courier and Parcel Delivery Services are subject to service-area, vehicle, Driver and Delivery Partner availability.
  2. Delivery is intended for permitted Parcels that can be safely transported by two-wheeler.
  3. DJ Cabs may impose limits on:
    • Parcel size;
    • Parcel weight;
    • Parcel value;
    • number of Parcels;
    • delivery distance;
    • delivery locations; and
    • permitted contents.
  4. The Sender must ensure that the Parcel is ready for pickup at the selected location and time.
  5. The Sender must not hand over a Parcel that requires refrigeration, special security, special licensing or special handling unless DJ has expressly accepted such requirements.
  6. The Sender and Receiver must cooperate with reasonable verification, OTP and delivery confirmation procedures.
  7. DJ Cabs may refuse, cancel, return or suspend a Delivery where required for safety, legal, operational or security reasons.

 

22. CUSTOMER COMMUNICATIONS

DJ Cabs may communicate with Users through:

Essential Service communications may continue even if a User opts out of promotional communications.

 

23. PERSONAL DATA AND PRIVACY

  1. DJ Cabs may collect and process personal information necessary to provide, secure and improve the Services.
  2. Such information may include:
    • name;
    • mobile number;
    • email;
    • pickup and delivery locations;
    • Receiver details;
    • location;
    • Ride and Delivery information;
    • Parcel-related information;
    • device information;
    • payment information;
    • communications;
    • emergency contact information; and
    • other information described in the DJ Privacy Policy.
  3. Personal information will be handled in accordance with the DJ Cabs Privacy Policy and Applicable Law.
  4. DJ Cabs may use authorised third-party service providers for payment processing, mapping, hosting, communication, verification, analytics, security, delivery support and other operational purposes.
  5. Users should review the DJ Privacy Policy for detailed information about collection, use, retention and deletion of personal data.
  6. Users must not provide personal information of another person unless they have lawful authority or consent to do so.

 

24. RATINGS, REVIEWS AND FEEDBACK

  1. Users may be permitted to rate or review Drivers or Delivery Partners after completing a Service.
  2. Reviews must be based on genuine experience.
  3. Users must not submit fake, abusive, discriminatory, threatening or fraudulent reviews.
  4. DJ Cabs may investigate complaints and take appropriate action where necessary.
  5. DJ Cabs may use aggregated and non-identifying feedback to improve its Services.

 

25. LOST PROPERTY AND UNDELIVERED PARCELS

  1. Passengers are responsible for their personal belongings.
  2. If an item is left during a Bike Taxi Ride, the Passenger should contact DJ Cabs support as soon as reasonably possible.
  3. DJ Cabs may facilitate communication between the Passenger and Driver for recovery of a lost item.
  4. DJ Cabs cannot guarantee recovery of lost property.
  5. For undelivered Parcels, DJ Cabs may attempt to contact the Sender or Receiver and may arrange return delivery where available.
  6. Additional charges may apply for return delivery, reattempts, waiting time or storage where permitted.
  7. DJ Cabs may handle unclaimed Parcels in accordance with Applicable Law and its applicable policy.
  8. DJ Cabs will not be responsible for loss, theft or damage to belongings or Parcels except where liability cannot legally be excluded.

 

26. SERVICE AVAILABILITY

  1. DJ Cabs does not guarantee continuous availability of the Platform or any particular Service.
  2. Services may be unavailable due to:
    • weather;
    • traffic;
    • road conditions;
    • vehicle breakdown;
    • technical issues;
    • network failure;
    • government restrictions;
    • safety concerns;
    • maintenance;
    • incorrect or inaccessible addresses;
    • Receiver unavailability; or
    • other circumstances beyond DJ's reasonable control.
  3. DJ Cabs may temporarily suspend a Service for safety, regulatory, technical or operational reasons.

 

27. INTELLECTUAL PROPERTY

  1. The DJ Cabs name, logo, trademarks, software, design, graphics, content and technology are owned by or licensed to DJ Cabs.
  2. Users are granted a limited, personal, non-exclusive and non-transferable right to use the Platform for lawful purposes.
  3. Users must not:
    • copy or reproduce the Platform;
    • modify the Platform;
    • reverse engineer the software;
    • scrape Platform data;
    • commercially exploit DJ Cabs content;
    • misuse Driver Junction trademarks; or
    • attempt to create a competing product using DJ's proprietary technology or content without authorization.

29. DISCLAIMERS

To the maximum extent permitted by Applicable Law:

  1. The Platform is provided on an “AS IS” and “AS AVAILABLE” basis.
  2. DJ Cabsdoes not guarantee that the Platform will always be uninterrupted or error-free.
  3. DJ Cabs does not guarantee:
    • availability of a particular Driver or Delivery Partner;
    • availability of a particular vehicle;
    • exact pickup or delivery time;
    • exact route;
    • exact estimated fare or Delivery Charge;
    • uninterrupted Service;
    • successful delivery in every case; or
    • conduct of every User, Driver or Delivery Partner.
  4. DJ Cabs does not guarantee that a Parcel will be delivered if the Parcel is prohibited, improperly packed, incorrectly addressed, unavailable for pickup, refused by the Receiver or affected by circumstances beyond DJ's Cabs reasonable control.
  5. Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

 

30. LIMITATION OF LIABILITY

To the maximum extent permitted by Applicable Law:

  1. DJ Cabs shall not be liable for indirect, incidental, special or consequential losses arising from use of the Platform or Services.
  2. DJ Cabs shall not be responsible for losses arising solely from:
    • User conduct;
    • Driver or Delivery Partner conduct;
    • traffic or road conditions;
    • network failure;
    • third-party service failure;
    • inaccurate information provided by the User;
    • prohibited or undeclared Parcel contents;
    • inadequate packaging;
    • incorrect or inaccessible addresses;
    • Receiver unavailability; or
    • circumstances beyond DJ's reasonable control.
  3. Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, wilful misconduct or other matters that cannot legally be excluded.
  4. Any limitation of liability shall apply only to the extent permitted under Applicable Law.

 

31. INDEMNIFICATION

To the maximum extent permitted by Applicable Law, you agree to indemnify and hold harmless DJ and its directors, officers, employees, representatives and authorized service providers from claims, losses, damages, costs and expenses arising from:

  1. your breach of these Terms;
  2. misuse of the Platform;
  3. violation of Applicable Law;
  4. fraudulent activity;
  5. prohibited, illegal or undeclared Parcel contents;
  6. inadequate packaging or inaccurate Parcel information;
  7. infringement of third-party rights; or
  8. unlawful or abusive conduct by you.

This clause shall not require you to indemnify DJ for matters finally determined to have resulted from DJ's fraud or wilful misconduct.

 

32. FORCE MAJEURE

DJ Cabs shall not be responsible for delay, interruption or failure caused by circumstances beyond its reasonable control, including:

 

33. ACCOUNT SUSPENSION AND TERMINATION

  1. You may stop using the Platform at any time.
  2. DJ Cabs may suspend or terminate an Account where:
    • these Terms are violated;
    • fraudulent activity is suspected;
    • false information is provided;
    • the Platform is misused;
    • safety or security is threatened;
    • prohibited Parcels are attempted or sent;
    • required payments remain unpaid; or
    • suspension or termination is required or permitted by law.
  3. DJ Cabs may take temporary preventive action while investigating a serious safety, security, delivery or fraud concern.
  4. Account termination does not automatically require immediate deletion of all information where DJ Cabs is legally required or permitted to retain such information.

 

34. ACCOUNT DELETION

Customers may request deletion of their DJ Account through the Account Deletion functionality available on the Platform or by contacting DJ.

Account deletion will be handled in accordance with the DJ Cabs Account Deletion Policy and Applicable Law.

35. PROMOTIONS AND COUPONS

  1. DJ Cabs may provide discounts, promotional codes, referral benefits, rewards or other offers.
  2. Promotional offers may have separate terms and eligibility requirements.
  3. Unless otherwise stated, promotional benefits:
    • are non-transferable;
    • cannot be exchanged for cash;
    • may have expiry dates; and
    • may be limited to eligible Users.
  4. DJ Cabs may cancel or withdraw promotional benefits in case of fraud, misuse, technical error or violation of promotional terms.

 

36. CHANGES TO SERVICES AND TERMS

  1. DJ Cabs may modify these Terms from time to time.
  2. Updated Terms may be published on the Platform.
  3. Where material changes require notice under Applicable Law, DJ Cabs will provide appropriate notice.
  4. Continued use of the Platform after the effective date of updated Terms will be subject to the updated Terms, to the extent permitted by Applicable Law.

39. GOVERNING LAW AND JURISDICTION

  1. These Terms shall be governed by the laws of India.
  2. Subject to mandatory statutory rights and Applicable Law, courts having appropriate jurisdiction in Lucknow, Uttar Pradesh, India shall have jurisdiction over disputes arising from these Terms.
  3. Users are encouraged to first contact DJ Cabs Customer Support or the Grievance Officer to resolve complaints.

 

40. DISPUTE RESOLUTION

  1. Any dispute should first be raised through DJ's customer support or grievance mechanism.
  2. The parties shall make reasonable efforts to resolve disputes amicably.
  3. Where legally permissible and mutually agreed, an unresolved dispute may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.
  4. The seat and venue of arbitration shall be Lucknow, Uttar Pradesh, unless otherwise required by Applicable Law or mutually agreed.
  5. The arbitration shall be conducted by a mutually appointed sole arbitrator, where applicable.
  6. The language of arbitration shall be English unless otherwise mutually agreed.

 

41. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue to remain effective.

 

42. WAIVER

Failure by DJ to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.

 

43. ENTIRE AGREEMENT

These Terms, together with the:

constitute the agreement governing the User's use of the DJ Cabs Platform and Services.

 

44. ACCEPTANCE

By clicking “I Agree”, “Continue”, “Register”, “Book Bike Taxi”, “Book Delivery”, “Confirm Booking” or any similar button, or by accessing or using the DJ Cabs  Platform or Services, you acknowledge that:

  1. you have read and understood these Terms;
  2. you agree to be bound by these Terms;
  3. you have reviewed the applicable DJ Cabs policies;
  4. you consent to the processing of information in accordance with the DJ Cabs Privacy Policy; and
  5. you agree to comply with Applicable Law.
